When one passes away without leaving behind a will, this person is known as an "intestate". In Singapore, the intestate's assets are dealt with subject to the Intestate Succession Act of 1967. Section 7 of the Act provides for 9 rules which govern the way the deceased's assets should be distributed.

If a person passed away without a valid will, leaving behind a spouse and children as well as children of a previous marriage, half the person's estate will have to be shared by both children of the current marriage as well as children of the previous marriage which ended in divorce. If a valid will were written, the person's wish to give what to whom and how much will take effect, and avoid the application of the Intestate Succession Act.
