3.1 The Seller confirms that as at the Option Date, he has either ---
(a) satisfied the minimum occupation period determined by the Housing and Development Board
("HDB"); or
(b) not satisfied the minimum occupation period but has obtained the HDB's prior written consent for
the sale of the Flat.
3.2 If the Seller has not met the requirement in Clause 3.1, this Option will be null and void. The Seller will
return to the Buyer any monies paid by the Buyer to the Seller, whether or not the Buyer has exercised
this Option. The Buyer may pursue any other claim he may have against the Seller.

我也觉得拿回定金，重新找个合适的中介，别等来等去一旦人家房子重新估价，又涨价了，自己更被动~ 好的房源也很多~

这里写的很淸楚，mop不够，买卖合约无効。

The Seller will return to the Buyer any monies paid by the Buyer to the Seller, whether or not the Buyer has exercised this Option.

不管ex与否（给4千）卖主都需要把钱退还给买主，
The Buyer may pursue any other claim he may have against the Seller.

这里我感觉有一点矛盾，既然合约无効，要以什么约束力来要求赔偿？

假如要求赔偿，就需要动用律师，几千元跑不了。（律师可能说有得打，没得打，他吃什么，打下去，几万就不一定）
要赔偿什么？
银行的解约费，1。5% of the Loan amount（40万=6千)+杂费+精神损失费+？？？
与其以几千元，来追讨几千元（throw the good money after the bad money ) 还不如：-
1。 拿回5千，能要点车马费就要点，要不到就算了。
2。 快去找另一套，
3。跟银行商量，把这一套的贷款三个月内转去另一套，取消罚款。

个人愚蠢见解，信者自误。

  谢谢前辈指点，我的中介什么都说她不知道，就是我们觉得那个房子还可以，在pionner MRT 附近，BLK988,我们也是考虑600多，700多号那边的我们已经买不进了，800多，900多的主人房是那种老式的，床怎么摆都不知道，而且房子旧，所以现在舍不得放，就是怕如果要等到12月份过后，到时估价又涨了，就是希望我们现在先协议好，到时还是现在这个价钱成交，不知道可以不？

首先是你的中介失职，可以投诉或起诉他吧
